Terms of Service

These Terms of Service (“Terms”) govern your use of BoatQuote (the “Service”), a SaaS marketplace platform that connects yacht crew members (“Yacht Users”) with suppliers and service providers (“Suppliers”) in the yachting industry. BoatQuote is operated by Marine Tech Management LLC, a Florida limited liability company with its principal place of business in Fort Lauderdale, Florida (“BoatQuote”, “we”, or “us”). By creating an account or using the Service you agree to these Terms.
1. Accounts
You may register as a Yacht User or as a Supplier. You must provide accurate, current, and complete information, keep your credentials confidential, and promptly update your information when it changes. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.
2. Platform Role
BoatQuote is a software-as-a-service marketplace platform. We provide the technology that allows Yacht Users to request quotes and Suppliers to respond, but we do not perform, supervise, inspect, guarantee, manage, or warrant any service, parts, repair, maintenance, or other work arranged through the Service. All agreements for goods or services are formed directly between the Yacht User (or the yacht they represent) and the Supplier. BoatQuote is not a party to those service contracts and is not a yacht agent, broker, contractor, employer, or supplier.
3. Quotes and Jobs
- Quotes submitted by Suppliers are binding offers until the Supplier withdraws them or a reasonable time has passed.
- Approving a quote creates a direct contractual relationship between the Yacht User’s yacht and the Supplier; BoatQuote is not a party to that contract.
- Pricing, taxes, warranties, lead times, parts sourcing, on-site work, and delivery terms are the responsibility of the contracting parties.
4. Subscription Fees & Billing
Access to the Service requires a paid subscription. During the current launch period, every new account receives a 180-Day Free Trial. After the Free Trial expires, the subscription you selected at signup will renew automatically at the published rates unless you cancel beforehand. Pricing as of the “Last updated” date above:
- Suppliers: $199 per month, or $1,990 per year (paid upfront).
- Yacht Crew: $249 per month, or $2,490 per year (paid upfront).
You may cancel before the Free Trial ends to avoid being charged. By entering a payment method at signup, you authorize BoatQuote (acting through our payment processor, Stripe, Inc.) to automatically charge the selected subscription plan when the Free Trial expires unless you have cancelled beforehand. Annual plans are billed upfront for the full twelve-month term. Paid subscription charges are generally non-refundable unless required by law or expressly approved by BoatQuote in writing.
BoatQuote reserves the right to modify pricing, subscription plans, Free Trial durations, promotional offers, platform features, and service availability at any time. Changes will not affect an active billing period that has already been paid for.
5. Cancellation Policy
- You may cancel your subscription at any time.
- Cancellation prevents future renewals but does not entitle you to a refund for the current billing period unless required by law.
- Cancelling during the Free Trial prevents any charge from being processed when the trial ends.
- Cancelling after billing begins does not automatically create a refund. Access typically continues until the end of the current billing period.
- You can cancel from Settings > Manage Subscription inside the Service.
6. Promotional Offers
BoatQuote may offer launch promotions, Free Trials, discounts, referral credits, or other special offers from time to time. Such offers are provided at our discretion, may be limited to specific users or time periods, and may be modified, suspended, or discontinued at any time without notice. Offers are not transferable and cannot be combined unless expressly stated.
7. Acceptable Use
You agree not to:
- Create fake accounts, post false or misleading information, or impersonate another person, company, or yacht;
- Scrape, harvest, or otherwise extract data from the Service through automated means without our written consent;
- Attempt to bypass, disable, or interfere with security, authentication, rate limits, or any other technical measures protecting the Service;
- Send spam, unsolicited offers, or otherwise contact users outside the stated purpose of the Service;
- Engage in fraudulent activity, including chargeback fraud, fake quotes, fake jobs, or fake reviews;
- Use the Service to build, support, train, fine-tune, benchmark, or assist a product or platform that competes with BoatQuote;
- Use the Service for any unlawful purpose or to violate any third-party rights.
8. Intellectual Property & Platform Protection
All BoatQuote software, source code, workflows, dashboards, screens, user interfaces, user experiences, branding, logos, trademarks, text, graphics, copy, platform structure, database schema, and functionality are and shall remain the exclusive property of BoatQuote and its licensors. No rights are granted to you by implication, estoppel, or otherwise except the limited right to use the Service as expressly described in these Terms.
You may not:
- Copy, reproduce, clone, reverse engineer, decompile, disassemble, scrape, resell, imitate, modify, distribute, or create derivative works based on the Service or any part of it;
- Use BoatQuote content, workflows, screens, designs, brand assets, or materials to build, support, market, or assist a competing platform or service;
- Remove or obscure any proprietary notices on the Service.
Normal screenshots for support requests, internal training, internal business records, or accompanying a feedback report to BoatQuote are permitted.
9. Supplier Responsibility
Suppliers are independent businesses, not employees or agents of BoatQuote. Suppliers are solely responsible for the accuracy and legality of:
- Company information and contact details;
- Service descriptions, scope, and capabilities;
- Pricing, taxes, payment terms, and invoices;
- Warranties, guarantees, and service-level commitments;
- Licenses, certifications, insurance, and any registrations required to lawfully perform the offered services;
- Tax classification, tax collection, and remittance obligations in their jurisdiction;
- Their actual ability to perform the services they offer, including any subcontractors or staff they engage.
10. Yacht User Responsibility
Yacht Users are responsible for the accuracy of all information they submit, including:
- Yacht information (name, type, flag, length, gross tonnage, etc.);
- Job descriptions, scope of work, technical specifications, and any uploaded photos or documents;
- Budgets, schedules, deadlines, and locations;
- Approval decisions, including any approvals routed to the Captain or another authorized representative of the yacht;
- Confirming they have authority to engage Suppliers on behalf of the vessel and its owner where applicable.
11. Disputes Between Users
BoatQuote is not responsible for disputes between Yacht Users and Suppliers, including disputes over service quality, scope, timing, pricing, payment, warranties, damage, or any other commercial matter. Users agree to resolve service-related disputes directly with each other. BoatQuote may, at its discretion and as a courtesy, assist with communication or provide records relevant to the dispute, but is not obligated to mediate, arbitrate, or resolve any dispute, and shall not be liable for the outcome.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We make no warranty as to the quality, qualifications, identity, or legality of any Yacht User or Supplier or any work they perform.
13. Limitation of Liability
To the fullest extent permitted by law, BoatQuote shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including (without limitation):
- The performance, non-performance, or quality of any Supplier’s services;
- Yacht downtime, scheduling delays, or missed charter windows;
- Lost profits, lost revenue, or lost business opportunities;
- Damage to vessels, cargo, equipment, or other property;
- Data loss or corruption;
- Personal injury arising from work arranged through the Service;
- Any indirect or consequential damages of any kind.
Our aggregate liability for any direct damages will not exceed the subscription fees you have actually paid to BoatQuote in the twelve (12) months preceding the event giving rise to the claim, or USD $100 if no fees have been paid. Some jurisdictions do not allow certain of these limitations, in which case they apply only to the maximum extent permitted.
14. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms, that pose a risk to other users, or for non-payment. Upon termination, your right to use the Service ceases; sections of these Terms that by their nature should survive termination (including but not limited to Sections 8, 9, 10, 11, 12, 13, and 15) will survive.
15. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service shall be the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
16. Changes
We may update these Terms from time to time. Material changes will be announced via the Service or by email at least seven (7) days before they take effect. Continued use after a change constitutes acceptance of the revised Terms.
